The Vivahcity website is not to be used in a way that may cause the websites functionality to be interrupted, damaged or is in anyway impaired.
The Vivahcity website is not to be used in a way that violates or infringes the rights of any person, firm or company (including rights of privacy and confidentiality).
To provide increased value to our users, we may provide links to other websites or resources for you to access at your sole discretion. You acknowledge and agree that, as you have chosen to enter the linked website we are not responsible for their content, availability, product or services provided by them. These sites hold their own terms and conditions and privacy practices.
These conditions can be changed from time to time by us. If you continue to use this website once these changes have been made then this will be a confirmation of your acceptance of the change to the conditions.

YOUR OBLIGATION TO US

Defamatory, offensive, malicious and obscene material must not be uploaded or transmitted through the Vivahcity website that may cause inconvenience, annoyance, corrupt data and is technologically harmful.
The Vivahcity website is not to be used in a way that infringes upon any persons or company proprietary rights.
If due to the use of this website (including the downloading of images) and the use of links provided on this website, your computer (equipment and programs) is infected with a virus or harmful material has caused your device to be infected we are not to be held responsible for this.

WEBSITE INFORMATION DISCLAIMER

Our goods are all handmade and to the highest quality but there can be some variation between similar products and we cannot be held responsible for this.
The colour of the product when it arrives may have a slight variation to its colour on screen. We try very hard to display the exact colour but the colour you see will depend on your screen resolution, the graphic card you are using, and whether you are using a pad, phone or PC, Laptop to view the product.
All prices and descriptions are all correct but if we do find an error on the website and you have placed an order, we will contact you straight away and you will have the option to replace the order at the correct price or cancel it.
All prices are inclusive of VAT and delivery charges will be extra. The delivery charge information will be found on the Delivery page of the website.
If you are not able to use the Vivahcity website or part of the website because of reasons that we cannot control, we will not be responsible or eligible for any compensation. Please be aware that this website is due to change from time to time.
We at Vivahcity reserve the right to, (without having to give notice to you) modify, withdraw, temporarily or permanently part of, or the entire Vivahcity website and that we shall not be liable to you or any 3^rd party for this.
We may issue warnings, suspend, terminate or attach conditions to your access of the Vivahcity website if we deem necessary where there has been a reported violation of these conditions or any complaints made while we investigate.
We have the right to refuse and order placed by you.
Any content and activity associated with this website can be monitored by us.

SALE TERMS

Once an order has been placed by you, you are agreeing to purchase it, subject to availability and at the order price shown on the website at the time your order is placed.
Orders will be despatched once a pre-authorisation check has been done on your card and then the amount debited.
When you place an order, all details provided by you must be correct and true.
You must be the authorised credit or debit card user and there are sufficient funds available for the purchase.
You must have a valid PAYPAL account, and a valid debit or credit card.
Delivery times may change due to postal delays and other reasons beyond our control and we cannot be held responsible for this. Orders will be despatched provided they are available and we do adhere to keep to delivery times where possible.
We shall not be responsible for delays due to Force Majeure and we shall be liable for an extension of our obligation to you because the delay was beyond our control.
All prices reflected on the Vivahcity website are subject to change and we will notify you if such change occurs once your order has been placed.

REFUNDS/ EXCHANGES/ CANCELLATIONS/ RETURNS

Goods returned to us damaged/ not in original packaging/ mishandled by you will not be accepted.
We will authorise a return and refund if we send you a product you didn’t order.
In the interest of hygiene, Vivahcity reserves the right to refuse to take back or exchange any goods that have been worn.
Most of our goods are handmade and because of this there can be slight alterations and defects amongst products, especially products of the same kind and we cannot be held responsible for this. The products are of course made to the highest quality.
It is not our responsibility if a good is damaged whilst being sent to you, or if it arrives late. This should be taken up with our parcel couriers (Royal Mail). If they do fail to compensate you for these goods, once we receive them back, we agree to refund you or despatch new goods to you, but this is under manager’s discretion.
There is a 7 days return policy to receive a full refund or exchange of product/ goods as long as it received by us in its original packaging with a proof of original delivery. You should also provide your order number and your details. Before you receive a refund or replacement you must email info@vivahcity.com or send us a letter with your order and then it is at the manager’s discretion the next course of action.
If the incorrect mailing address is given by you, this is not our responsibility. If the delivery arrives and you are not at home, it is your responsibility to collect your order.
If goods are returned to us by Royal Mail or our courier company then a postage fee will be applied to your account for the redelivery of your goods.
Additional compensation will not be offered for any disappointment suffered in an order placed.

Severance

If any part of the Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Conditions.

Survival

Each provision of the Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

WAIVER

If any conditions are breached, there will be nothing that can be understood as a waiver.

INDEMNITY

By accessing this website you agree to fully indemnify, defend and hold us, our officers, directors, employees, agents and suppliers harmless indemnity on demand, from and against all claims, liability, damages, losses, costs, expenses (including reasonable legal fees) arising from any breach of these terms and conditions by you or any other liabilities arising out of your use of the website or any person using the website through your account or PC.

GOVERNING LAW

These terms and conditions, all transactions relating to this website and all non-contractual obligations arising from any transaction carried out on this website are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
